Terms of Service.

1. The service

SENDANYWAIR provides tools for secure file transfer. The service includes secure download links, direct P2P transfer, P2P sender apps, P2P receiver apps, messages, password protection, transfer status, and license-based access.

P2P transfers are different from secure-link transfers. In P2P mode, file contents move directly from the sender device to the receiver device and are not stored on our servers.

2. Accounts and responsibility

You are responsible for your account, login credentials, recipients, file choices, messages, and use of the service. You must provide accurate account and billing information and keep your login details secure.

You may not use another person's account without permission or attempt to bypass license limits, storage limits, security checks, or access controls.

3. Files and storage

For standard SENDANYWAIR secure links, files are temporarily stored so the recipient can download them. As soon as the expected download is complete, the file is deleted from our storage. Files that are not downloaded are removed when their retention period expires.

For SENDANYWAIR P2P, the file contents are not uploaded to our storage and are not stored on our servers. Our systems may still process account, license, invitation, connection, status, and technical metadata needed to operate the service.

You remain responsible for the files you send and for making sure that you have the right to send them.

4. Plans, payment, and access

After registration, SENDANYWAIR activates a 1 hour license automatically. SENDANYWAIR also offers day, week, month, and year passes. Each pass may include different duration, storage, and retention limits. Current pricing is shown on the pricing page and in the app before checkout.

Checkout is handled through Stripe. We do not store full card details. Month and year passes may be recurring and can be cancelled in accordance with the app flow and the Refund and Withdrawal Policy.

5. Acceptable use

You must not use SENDANYWAIR to send, host, distribute, or facilitate unlawful, harmful, abusive, infringing, or malicious content. The Acceptable Use Policy is part of these terms.

We may suspend or terminate access, remove files, block links, or take other action when we reasonably believe the service is being misused, required by law, or necessary to protect users or the service.

6. Availability and changes

We aim to keep the service available and reliable, but we do not guarantee uninterrupted or error-free operation. Transfers can fail because of network conditions, browser restrictions, device settings, receiver availability, third-party providers, or other technical reasons.

We may improve, change, limit, or discontinue parts of the service when needed. If a change materially affects paid access, we will handle that fairly and in line with applicable law.

7. Liability

To the extent permitted by law, SENDANYWAIR is not liable for indirect damage, loss of profit, loss of business, loss of data, failed transfers, unauthorized use caused by compromised credentials, or content sent by users.

Nothing in these terms limits rights that cannot be limited under applicable consumer law.

8. Suspension and termination

You may stop using the service at any time. We may suspend or terminate access if you breach these terms, misuse the service, create risk for other users, fail to pay, or if we are legally required to do so.

9. Law and disputes

These terms are intended to be governed by Dutch law, without depriving consumers of mandatory protections that apply in their country of residence. If a dispute occurs, contact us first so we can try to resolve it directly.
